Process of signing a power of attorney outside the UAE

For any power of attorney to be used in the UAE, it is not mandatory that such power of attorney is signed by the person (known as ‘principal’)inside the UAE. A power of attorney can become valid in the UAE even if it is signed by the principal outside the UAE.

If you intend to sign the power of attorney outside the UAE and then use it in the UAE, the power of attorney is required to undergo the process of legalization and authentication in the country of origin and the UAE.

For ease of understanding, we have divided the process of legalization and authentication in the following two (2) stages:

Stage 1 – Steps to be taken in the country of origin

You will be required to carry out the following steps outside the UAE before the power of attorney can be brought inside the UAE to commence stage 2.

1. As a first step, you (principal) will need to sign the power of attorney before a notary public in the country where you are currently present.
2. Once the power of attorney has been signed at the notary public, you will need to have the power of attorney attested by the ministry of foreign affairs (or equivalent government department) in the same country.
3. As a last step in stage 1, you will need to have the power of attorney certified by the UAE Embassy/Consulate in the same country.

The notary public fee and the government fee for the above process may vary depending upon the nature of the power of attorney and if it is treated as a personal or a commercial/company document.

Stage 2 – Steps inside the UAE

Once stage 1 has been completed, the power of attorney can be brought into the UAE for the completion of the authentication process. You will need to take the following steps as part of this stage:

1. As a first step, you will need to have the power of attorney stamped by the UAE Ministry of Foreign Affairs.
2. Once the power of attorney is stamped by the UAE Ministry of Foreign Affairs, it will need to be translated into Arabic by the legal translators authorized to undertake legal translation by the UAE Ministry of Justice.
3. Once the Arabic translation is completed, you will need to have the power of attorney stamped by the UAE Ministry of Justice to certify the Arabic translation.
